1. Agreement Overview

Welcome to sec30.com ("the Service"), operated by Orbitum Tech OÜ, a company registered in Estonia (Registration Number: 17390885), with its registered address at Harju maakond, Tallinn, Lasnamäe linnaosa, Võru tn 11, 13612, Estonia. By accessing or using our Service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

2. Service Description

Sec30 provides an AI-powered creative platform enabling users to interact with various artificial intelligence models for chat, image generation, and content creation. Our Service includes web-based tools for managing projects, generating creative content, and purchasing tokens to access AI capabilities.

The Service integrates third-party AI providers (including large language models and image generation models) and third-party payment processors. Orbitum Tech OÜ does not control these third-party services and is not responsible for their availability, accuracy, or the terms they impose. Your use of such third-party services is subject to their respective terms and policies.

Orbitum Tech OÜ reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. We may introduce new features, change existing functionality, or remove capabilities as we develop the platform.

Service deliverable: Upon purchasing tokens, the Service deliverable is access to AI-generated outputs (text responses and/or images) produced by automated software models based solely on your inputs. No human involvement, review, or quality assurance is applied to individual outputs. Tokens are consumed per-use at rates displayed within the application and on the pricing page.

2A. AI-Specific Disclosures and Limitations

By using the AI features of the Service, you acknowledge and agree that:

• AI-generated outputs (text, images, and other content) may be inaccurate, incomplete, misleading, or otherwise flawed. You are solely responsible for reviewing, verifying, and validating all AI outputs before relying on or distributing them.
• AI outputs do not constitute professional, legal, medical, financial, or any other form of expert advice.
• There is no guarantee of originality or exclusivity. AI models may produce similar or identical outputs for different users or prompts. You should not assume that any AI-generated content is unique to you.
• AI models may occasionally produce content that is offensive, biased, or otherwise objectionable. Orbitum Tech OÜ does not endorse any AI-generated content and is not liable for its nature or consequences.
• The quality, style, and capabilities of AI outputs may vary and change over time as underlying models are updated by their respective providers.
• Orbitum Tech OÜ makes no representations or warranties regarding the suitability of AI-generated content for any particular purpose, including commercial use.

3. User Eligibility & Accounts

To use our Service, you must:

• Be at least 18 years old or have reached the legal age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Provide accurate, complete, and current registration information
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities occurring under your account
• Notify us immediately at [email protected] of any unauthorized access

Orbitum Tech OÜ may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods.

4. Tokens & Payment

Our Service operates on a token-based system where 1 EUR equals 10 tokens. By purchasing tokens, you acknowledge:

• Tokens are a non-redeemable internal usage credit for accessing the Service and are not electronic money, cryptocurrency, or a payment instrument
• Tokens are non-transferable between accounts and carry no cash value
• Purchased tokens do not expire while your account remains active
• All purchases are final, subject to our Refund Policy and your statutory rights
• Prices may be adjusted with reasonable notice to users
• You are responsible for applicable taxes based on your jurisdiction

Payments are processed through secure, PCI DSS-compliant third-party payment providers. Orbitum Tech OÜ does not store complete payment card details on our systems. Orbitum Tech OÜ is the merchant of record for all transactions; payment processing is performed by our payment service provider on our behalf. Card statements will show a billing descriptor similar to 'SEC30', 'ORBITUM TECH'.

No subscriptions or recurring charges: The Service operates on a one-time token purchase model. There are no recurring subscriptions or automatic renewals. Each token purchase is a separate, one-time transaction. You are not charged again unless you initiate a new purchase.

4A. Consumer Withdrawal Right

If you are a consumer within the European Union or the European Economic Area, you have a statutory right to withdraw from a distance contract within 14 days of purchase without giving any reason.

However, by purchasing tokens and using them to access AI services, you expressly consent to the immediate performance of the Service and acknowledge that you lose your right of withdrawal once tokens have been used or the digital content has been supplied. You will be asked to provide this consent during the checkout process.

For unused tokens, you may exercise your withdrawal right by contacting us at [email protected] within 14 days of purchase.

Consumers may also bring claims before the competent courts of their Member State of residence and may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

5. Acceptable Use Policy

You agree to use the Service responsibly and lawfully. Prohibited activities include:

• Generating illegal, harmful, threatening, or malicious content
• Creating content that infringes intellectual property rights
• Impersonating individuals, organizations, or AI systems
• Attempting to circumvent security measures or access restrictions
• Interfering with Service operation or other users' experience
• Using automated tools to extract data without authorization
• Distributing spam, malware, or unsolicited commercial content
• Generating child sexual abuse material (CSAM) or any sexualised content involving minors
• Creating content designed to facilitate fraud, scams, phishing, or financial deception
• Producing instructions or guides for illegal activities, violence, self-harm, or manufacture of weapons or controlled substances
• Generating non-consensual intimate imagery or deepfakes of real individuals
• Any activity violating applicable local, national, or international laws

We reserve the right to suspend or terminate accounts engaged in abusive, high-risk, or anomalous usage patterns, including but not limited to excessive automated requests, prompt injection attempts, or systematic exploitation of AI outputs.

Technical safeguards: To enforce this policy, the Service employs automated content moderation at multiple levels: a real-time keyword and pattern blocklist that screens every user message and image-generation prompt, supplemented by an AI-powered classifier that evaluates higher-risk requests (such as image prompts) for policy violations before they reach the underlying AI providers. These systems are designed to prevent the generation of child sexual abuse material (CSAM), deepfakes, non-consensual intimate imagery, explicit adult content, weapons or drug-manufacturing instructions, phishing or fraud content, and infringing reproductions of copyrighted works. Requests that violate these rules are rejected automatically and may trigger account review.

6. Intellectual Property

Our Content: All Service components - including software, algorithms, user interface designs, logos, and documentation - are owned by Orbitum Tech OÜ or our licensors and protected by international intellectual property laws.

Your Content: You retain ownership of content you create using the Service. By submitting content, you grant Orbitum Tech OÜ a limited, non-exclusive, royalty-free license to store, display, and process your content solely as necessary to provide and operate the Service. This license does not grant the Company the right to sell, sublicense, or use your content for purposes unrelated to providing the Service.

Generated Content: Images and text generated through AI models may be used in accordance with your token purchase. Personal, non-commercial use is permitted with any token purchase. Commercial use rights may be available - contact [email protected] for details.

7. Content Responsibility

You are solely responsible for content you create, submit, or generate through the Service. While we do not actively monitor user content, we reserve the right to remove material that violates these Terms or applicable laws. Orbitum Tech OÜ is not liable for any content created by users or AI outputs.

8. Third-Party Services

The Service integrates third-party AI providers (such as large language model and image generation providers) and third-party payment processors. Orbitum Tech OÜ does not own, control, or operate these third-party services and is not responsible for their content, accuracy, availability, practices, or terms. Any issues arising from the use of third-party services should be directed to the respective third-party provider. Your use of third-party services is subject to their respective terms and policies. Users must also comply with the acceptable use requirements of our underlying AI providers where applicable.

8A. Data Protection

Personal data is processed in accordance with applicable data protection law, including Regulation (EU) 2016/679 (General Data Protection Regulation), and the Company's Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy, which describes how we collect, use, store, and disclose your personal data.

9. Service Availability

We strive to maintain reliable Service availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service interruptions.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Orbitum Tech OÜ does not warrant that AI-generated content will be accurate, complete, or suitable for any specific purpose.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBITUM TECH OÜ, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total aggregate liability for any and all claims arising out of or related to these Terms or the Service shall not exceed the total amount you paid for the Service in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms shall limit liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct.

This limitation is intended to allocate risk fairly between the parties and does not affect any mandatory consumer rights that cannot be waived under the laws of your jurisdiction.

12. Indemnification

You agree to indemnify and hold harmless Orbitum Tech OÜ, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

13. Termination

Orbitum Tech OÜ may suspend or terminate your access without prior notice for Terms violations, fraudulent activity, or other conduct we deem harmful. You may close your account at any time by contacting [email protected]. Upon termination, your license to use the Service ends, and you may lose access to your account data and generated content.

14. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved as follows:

• First, contact us at [email protected] to seek informal resolution
• If unresolved, disputes shall be submitted to binding arbitration in Estonia
• Arbitration shall be conducted in English under recognized arbitration rules
• You agree to resolve disputes individually, not as part of class actions

EU/EEA Consumer Exception: If you are a consumer habitually resident in the European Union or European Economic Area, the binding arbitration requirement and class-action waiver above do not apply to you. You retain the right to bring claims before the competent courts of your Member State of residence in accordance with Regulation (EU) No 1215/2012 (Brussels I Recast) and applicable national consumer protection law. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Changes to Terms

Orbitum Tech OÜ may update these Terms periodically. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance. If you disagree with updated Terms, you must discontinue using the Service.
